Donation and Gift Refund Policy and Agreement
This Donation and Gift Refund Policy and Agreement (the "Agreement") constitutes a legally binding agreement between The Fajiri Family Relief Foundation ("FFRF," "Organization," "we," "us," or "our") and any individual or entity making a donation or providing a gift ("Donor," "you," or "your").
For the purposes of this Agreement, "donations" and "gifts" include contributions made directly to FFRF, as well as contributions made to or for the benefit of any active Member through fundraising campaigns or goodwill-based direct giving conducted in alignment with FFRF's mission and core values.
By making a donation to FFRF and/or indicating your acceptance (including by selecting an acknowledgment checkbox), you confirm that you have read, understood, and agree to be bound by the terms of this Agreement.
All donations made to FFRF are voluntary contributions intended to support the Organization's charitable and humanitarian purposes, initiatives, outreach programs, and operations, including but not limited to:
Donations may also be used for reasonable administrative, operational, compliance, safeguarding, technology, outreach, staffing, or governance costs necessary to support FFRF's mission.
Unless expressly agreed otherwise in writing, all donations are unrestricted and may be used at the discretion of the FFRF to further its charitable and humanitarian mission. Where the FFRF accepts a donation subject to a specific restriction, it will make reasonable efforts to apply the funds in accordance with that restriction. If the restricted purpose becomes impossible, impracticable, or inadvisable, FFRF reserves the right to reallocate such funds in a manner consistent with its charitable objectives and applicable law. However, FFRF shall not be liable for delays, interruptions, or inability to utilize or distribute donations caused by events beyond its reasonable control.
1.1. Donation Specification
If you wish to donate to a specific cause or program—such as community housing and shelter for the homeless, emergency and disaster relief, education and skills development for youth and adults, or sports development (including soccer or basketball)—you may indicate your preference to the FFRF, and your donation will be directed toward that particular cause.
The FFRF will make reasonable efforts to apply such donations in accordance with the donor's expressed intention. However, if the specified purpose becomes impracticable, unavailable, or inconsistent with operational or legal requirements, the FFRF reserves the right to reallocate the donation in a manner consistent with its charitable, humanitarian mission and applicable laws.
1.2. Household and Consumable Items
The FFRF accepts donations of tangible goods, including but not limited to clothing, merchandise, household items, food, and other consumable goods, for distribution to individuals and communities in need. Donors are responsible for ensuring that all donated items are safe, lawful, and in suitable condition for use or distribution. The FFRF reserves the right to decline, refuse, or dispose of any items that do not meet its standards, safety requirements, or applicable regulatory guidelines.
All such item donations are final and non-refundable once received by the FFRF.
1.3. External and Internal Donors
The FFRF recognizes two categories of donors: External Donors and Internal Donors.
External Donors are individuals or entities who are not registered Members of the FFRF and are not directly or indirectly affiliated with the Organization. These donors contribute voluntarily, typically on a one-time or occasional basis, to support FFRF's mission and community impact initiatives.
Internal Donors are registered Members of the FFRF who may also be beneficiaries of its programs and actively participate and contribute in advancing the Organization's mission. Internal donors contribute regularly or as required to support programs within their communities, including initiatives they coordinate, support, or have an interest in developing. Internal donor contributions do not confer ownership, control, decision-making authority, or entitlement over any specific program, funds, or outcomes, unless expressly approved in writing by FFRF.
FFRF reserves the right to verify donor identity, source of funds, campaign legitimacy, beneficiary information, and transaction authenticity in accordance with applicable laws and internal compliance procedures.
Donations do not confer governance rights, management authority, voting rights, ownership interests, or control over FFRF assets, operations, programs, or decisions unless expressly provided in separate governing documents.
All donations, whether made by External or Internal Donors, are subject to the terms of this Agreement.
1.4. No Investment or Financial Return
Donations, gifts, and contributions made to FFRF or through the Platform are charitable or goodwill-based contributions only and do not constitute investments, securities, equity interests, profit-sharing arrangements, or financial instruments. Donors shall have no ownership, repayment, dividend, profit, or financial return rights arising from any donation or contribution.
1.5. No Fiduciary Relationship
Nothing in this Agreement creates any fiduciary, trustee-beneficiary, partnership, agency, or investment advisory relationship between FFRF and any donor unless expressly stated in writing.
All donations are final and non-refundable, except as expressly provided in this Agreement or as required by applicable law.
By making a donation, you acknowledge and agree that:
The FFRF may, in its sole discretion, acting reasonably and in good faith, consider refund requests in the following limited circumstances:
3.1. Error in Donation Amount
A refund may be considered in cases of clear and demonstrable error, including:
Requests must be submitted within seven (7) days of the transaction date.
3.2. Unauthorized Transactions
If a donation was made without your authorization (including fraudulent use of a payment method), you must:
The FFRF reserves the right to coordinate with financial institutions and payment processors in investigating such claims.
Donors represent and warrant that they are not subject to sanctions restrictions and that donations are not made in violation of applicable sanctions or trade laws.
3.3 Technical or Processing Errors
Refunds may be issued where:
Refund requests must be submitted in writing within the applicable timeframe.

Required Information:
The FFRF reserves the right to request additional information reasonably necessary to evaluate the request. However, refund requests that remain incomplete or unsupported for an extended period may be closed without further action.
All refund requests will be reviewed on a case-by-case basis. The FFRF retains discretion, exercised reasonably and in good faith, in determining whether a refund will be granted, subject to applicable law. Approved refunds will, where possible, be issued using the original method of payment.
Approved refunds are typically processed within 7 to 30 business days, depending on the payment method and financial institution.
FFRF is not responsible for delays caused by third-party payment processors, banks, or card issuers.
Donations processed in different currencies may be subject to exchange rates, banking charges, transaction fees, or payment processor deductions beyond FFRF's control.
Payment processing services are provided by independent third-party payment processors. FFRF is not responsible for technical failures, interruptions, processing delays, banking errors, or security breaches attributable to third-party payment systems.
Without limiting Section 2, refunds will not be issued in the following circumstances:
Where a refund is issued:
All tax receipt practices will comply with the requirements of the Canada Revenue Agency and other applicable regulatory authorities.
Nothing in this Agreement limits or excludes any rights you may have under applicable consumer protection, charity, or other laws.
Where required by law, FFRF will provide refunds or remedies in accordance with its legal obligations. Electronic acceptance, digital acknowledgment, or online confirmation shall constitute legally binding consent to this Agreement. FFRF may retain donation records, receipts, communications, and related documentation for legal, audit, compliance, safeguarding, and operational purposes.
To the fullest extent permitted by applicable law:
The FFRF reserves the right to challenge any chargeback where a donation is reasonably believed to be valid and authorized. You agree to contact FFRF prior to initiating a chargeback to allow for resolution.
The FFRF reserves the right to amend or update this Agreement at any time. Changes become effective upon posting or notification. Your continued use of FFRF's donation services constitutes acceptance of the revised Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the countries the FFRF is registered including but not limited to the Province of British Columbia and the applicable federal laws of Canada.
In the event of a dispute arising out of or relating to this Agreement:
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between you and FFRF regarding donation refunds and supersedes all prior or contemporaneous agreements, communications, or representations relating to its subject matter.
The FFRF may facilitate or support fundraising activities and goodwill-based contributions made to or for the benefit of individual Members. However, FFRF acts solely as a facilitating platform and is not a party to personal gift arrangements between Members. FFRF does not guarantee, control, or assume responsibility for the use, management, or outcome of funds transferred to individual Members. To the fullest extent permitted by applicable law:
